Quick Summary
If you've received a GST Show Cause Notice (SCN) for your new registration because the property owner and business proprietor relationship isn't clear, you need to provide proof. This typically involves submitting an affidavit or a specific No Objection Certificate (NOC) from the property owner, clearly stating their relationship to you and granting permission for business use. Ensure you also include proof of ownership for the property and respond to the SCN within the stipulated timeframe, usually 7 working days, via the GST portal.

Addressing the GST SCN To resolve the issue mentioned in the GST SCN, you'll need to provide a relationship proof between the owner of the property and the proprietor of the firm.

Here's what you can do: Relationship Proof Documents -

*Affidavit*:

You can submit an affidavit on a non-judicial stamp paper, mentioning the relationship between the property owner (your Masi) and the proprietor of the firm (you). -

*Specific NOC*: Obtain a specific NOC from your Masi, mentioning the relationship and granting permission to use the property for business purposes. Sample Format for Affidavit "

AFFIDAVIT

1. I am the owner of the property located at [Property Address].

 2. [Your Name], aged [Age], residing at [Address], is my [Relationship, e.g., nephew/niece], and I have given consent for using the said property for business purposes.

 3. I confirm that [Your Name] is the proprietor of the firm [Firm Name] and has been granted permission to use the property for business purposes.

I hereby confirm that the above statements are true and correct to the best of my knowledge and belief. Signature of [Your Masi's Name] Verification: I, [Your Masi's Name], do hereby verify that the contents of this affidavit are true and correct to the best of my knowledge and belief. Signature of [Your Masi's Name]" Specific NOC Format "NO OBJECTION CERTIFICATE I, [Your Masi's Name], aged [Age], residing at [Address], do hereby certify that:

 1. I am the owner of the property located at [Property Address].

 2. I have no objection to [Your Name], proprietor of [Firm Name], using the said property for business purposes.

3. [Your Name] is my [Relationship, e.g., nephew/niece], and I confirm that the property can be used for business purposes.

I hereby grant permission to [Your Name] to use the property for business purposes. Signature of [Your Masi's Name]" Next Steps -

*Submit Response*: Respond to the GST SCN with the required relationship proof documents. -

*Verification*: Ensure that the documents are properly verified and signed by the relevant authorities.

By providing the necessary relationship proof documents, you should be able to resolve the issue mentioned in the GST SCN.

thanks sir...cirtainly it is great help

GST registration show cause notices for "relationship not proved" come up when the principal place of business is in someone else's name.

What the GST officer needs to see in your reply:

1. NOC or Consent Letter from the property owner stating they permit use of the premises for business. Include date, property address, and owner signature.
2. Proof of relationship between the owner and the proprietor. For family property: Aadhaar of both, or a ration card showing the family connection. For an unrelated landlord: the consent letter plus the owner's ID proof is sufficient.
3. Proof of ownership: a recent electricity bill or property tax receipt in the owner's name.

If you have a registered rent agreement, submit that alone. A registered rent agreement already establishes the relationship and no separate NOC is needed.

Reply timeline: You get 7 working days from the SCN date to respond on the GST portal. Go to Services, then Registration, then Application for Rectification and upload the documents. Do not let the deadline pass as the application gets rejected automatically.
