Dear Sirs,
I am a software consultant doing 100% software service to clients across the globe. I have vendors who develop and bill me with GST locally within India. We have a large sum of GST paid, and we applied for GST refund. After a long delay, we received the SGST refund of 90% for July-Dec 2017.
However, we are asked my GST department to provide FIRC certificates, which our bank has not issued. Looks like as per FEDAI circular (https://www.fedai.org.in/DocumentUploadFiles/SPL-14-FIRC-2012.pdf) many banks have already stopped issuing FIRC, though RBI mandates it (https://www.rbi.org.in/scripttts/NotificationUser.aspx?Id=6148&Mode=0).
We also receive payments through PayPal which uses Citibank as they ForEx processing bank. From Citibank, we get as RTGS, to our business account in HDFC. Citibank is supposed to issue FIRC, and they are also not sending it, though we have paid them for all the certificates.
Now GST dept is asking to refund the SGST with interest and this has become a huge pain to us. We are much confused about this.
