Gst payment on independent house construction

Good day.

I have entered into contact with a building contractor for construction of my independent house in june-17. We agreed on fixed price of 1500 ₹/sq ft. All material and labour to be provided by building contractor. He agreed to give me all the invoices of material and also gave me some invoices without GST. but now he is refusing to give remaining invoices and seems like he haven't paid GST on material.

As it was fixed price contact and nothing is mentioned about GST. Is building contractor is supposed to pay GST on all material bought by him or I am supposed to Pay GST.

Can I file complaint with GST against him for getting all pending invoices?

What your contract specifies? Whether the constructed house property or only labour contract?

As per data available, you have contracted a house property fully constructed at rs. 1500/- per sq ft.

You are supposed to take only contractors tax invoice and not materials bill separately.

As per no clarification in agreement, if contractor is registered under GST;... he can charge 12% over and above his bill amount as GST over the contract price, as he is liable to collect the amount on behalf of Government.
