Quick Summary
This discussion addresses GST implications for unsold flats in projects completed before the GST regime, even if Occupancy Certificate (OC) is pending. It also covers liability for GST on outstanding payments for flats where VAT was previously paid. Experts advise that if construction was completed before GST and OC application was made, GST may not apply to unsold flats. For outstanding payments on pre-GST sales, service tax, not GST, might be applicable.

1. yes
2. Yes
Thanks

11. No if you applied for oc earlier and it is pending with the municipal authorities and you can depend because your construction is completed earlier. 2. no you will not liable for gst, but you will be liable for service tax, since it had occurred in the service tax regime.
