When something is without consideration, GST doesn't apply (Unless it's Schedule I item). So JIO hasn't evaded GST. If you think that's evasion, I pity your thinking though.
debatable issue.................

so how and when will the jio phones be taxed under GST,

@ FANOFNM, I LOVE MY COUNTRY AND ITS COUNTRYMEN....YOU DONT HAVE TO TEACH ME THAT  no

no clarification on that till now..........

Such a big company.. reliance..will not evade tax...

and in security deposit you are not required to collect tax....
So can't we even call it a master plan!
how can it be a security deposit rather than consideration for supply???...... plzz explain.....
Shailendra coz the 1500 deposit made by us to Jio is refundable
still as the co. is supplying the cellphone..... a direct linkage can be established(an imp aspect of consideration) and as the consideration is there, it should be taxed?...... please explain.....
may be they have paid gst out of pocket
thank you and congratulations

Hi,

Yes it is a Master plan and GST avoided but not evaded.

It means we can save gst on all fixed assets by taking security deposit as it's consideration and telling that we will refund your money if you bring back our asset after 10-15 year in prescribed condition and we know nobody can return assets in well condition like jio phone can not be used for 3 years

yes you are right but if not returned by the jio phone customer then GST liability arises for the phones not returned
