Gst on flat

i have a query. i am planning to buy a new flat. the flat construction is completed and it is ready for the possession. the 

construction is completed 1 year back. many people are living in the flat.

when i asked the builder for price he said that you will have to pay GST 12% of the value. that comes to around 3 lakh in my 

case and the flat is going out of budget.

Kindly guide me in this matter. As per the details available on the internet we dont have to pay GST for construction completed

before 1st July 2017. 

please help me. thanking you all

Yes, your search is correct........... GST is not applicable over any property, if completion certificate is received over the property.

Builder is trying to take advantage.......... so discuss with him about the point.........

Also sir can you by any chance have the authorised page or link of GST govt of india where such law clarification is given or

exact definition is given ? so in such case i will take out print and carry along with me in the meeting which shall strengthen my case.

Ans: GST will be charged only on those flats sold before getting the completion certificates. If the first consideration is received after Occupancy certificate or first occupation, then there shall be NO GST on such transactions.
