Gst late filing fee

My client has not filed Return from September 2018 and wants to surrender the GST. There is no sale but he has purchased some material. during this period. When tried to surrender GST it ask to file return first. The problem is that the penalty for not filing the return is approx one Lakhs. is there any chance to surrender without paying the penalty as there is no tax liability. Please suggest accordingly.

No....... there is no way out.

Yes can try by visiting to your jurisdiction tax officer but that to be with valid reason
as per you wrote, there is no turnover only purchases are there, so you can file nil returns for some months and include all the figures in March 2019 of 2018-19 and there after again you can file nil returns for some months and include all the figures in August month of 2019 for 2019-20. by which your taxpayer will get big relief for nil return there is only the late fees of RS 20.

Try filing NIL returns as there is no output. You could save some money.

But there is no way out as per law.

There is no way off waive off the late filing fee?  

The law has fixed a maximum late fees of Rs 5,000. This means that in any case, the maximum late fees that can be charged by the Government is Rs 5,000  each return being filed under each Act.

Any body can correct me on this?

I has the same case. A CA misinformed me. BTW, what could be a valid reason to give?
