GST for under construction flat

I have purchased a new flat and registered it in February 2017. I have paid all taxes as per agreement value(Full agreement). The project hasn't received OC yet. Bcoz of this the bank has not given the balance loan amount. We have already paid tax on this balance loan amount too. Now the builder is saying I have to pay GST on this balance amount if paid after 1st July,2017.
What does GST rules say about this?

If builder said that than builder must want to return previous taxes which he charged you.

No clarification over the dilemma of the customers like you...............

Only hope, Anti Profiteering provision to pass on the ITC benefit to customers.......

If unitedly represented by any organization, some solution bound to come.........

If the builder is not completing the work.  That is why the amount is pending  from bankers side. 

 

The statement of Builder is wrong.  You need not pay any GST on that amount.

what is your payment condition in sale deeds.It will depends for payment of GST.
if u HV registered flat purchase already them no GST

@ sharad:  For builder......... for unsold flats/units...... i.e. stock in trade...... no depriciation allowed.

For fixed assets depreciation of commercial bulding is taken as 10% as per IT act.......

If already Sale Deed Registered then there is no requirement to pay GST. Buider require to due Service Tax Liability as on Sale Deed Registered Date.
