Hi Rohan,
Here's how you can handle the GST registration issue in your case:
1. Cancellation of existing GST registration (as Tax Collector)
-
Normally, a taxpayer can apply for cancellation of GST registration if they no longer require it or have applied wrongly.
-
However, in your case since you registered as a tax collector (e-commerce operator), the GST portal may not allow direct surrender or cancellation if you don't meet the conditions.
-
You need to file an application for cancellation of registration in the GST portal under the Cancellation option. If you don’t see it, try the following:
If you do not see the cancellation option for that registration, it might be because the tax collector registration is linked with e-commerce activities and may require department intervention.
2. Applying for GST as Regular Taxpayer
-
You can have multiple GST registrations for different business verticals or states but not two registrations for the same business in the same state under different categories.
-
Since you have registered as a tax collector and also applied as a regular taxpayer, the portal may reject or keep pending the second application if it detects duplication.
-
Typically, you cannot have both types of registration for the same business premises under one GSTIN.
Suggested course of action:
-
Apply for cancellation of your Tax Collector registration first through the portal as mentioned above.
-
If cancellation option is not available, you may have to raise a query with GST helpdesk or file grievance on GST portal seeking cancellation.
-
After cancellation is approved and completed, you can continue with your regular taxpayer registration.
Additional points:
-
If your e-commerce activity involves collecting tax on behalf of other sellers, then tax collector registration is valid.
-
If you are selling goods yourself (not just collecting tax), you should be registered as a regular taxpayer.
-
You cannot claim input tax credit or file returns under tax collector registration because it’s meant only for collecting and remitting tax on behalf of sellers.
Bottom line:
Cancel the tax collector GST registration first, then proceed with the regular GST registration. Contact GST helpdesk if cancellation option is not visible.
