if it is salary income then Form-16 otherwise Form-16A. form-16 is a TDS certificate if TDS is not deducted then he is not under any obligation to provide you TDS certificate. However if he has deducted tax from your salary then it is mandatory from his part to issue you a form-16
The Employer is under the obligation to issue Form 16 to his employees from whom, he or she has deducted tax on salaries.
Form 16 A is for TDs other then salaries. If any TDs is deducted. But if in service u can ask if there is TDS deducted .neither u can file your return with salary certificate of the year with other income proof.
It very simple if he has deducted TDS from salary , it is mandatory for him to give you TDS certificate & vice-versa.

you can sue your employer.
