Can a person file his ITR when no form16 is provided by the employer? what are the formalities ?

Has employer has deducted TDS? He must have ...... if so why is he not giving you Form 16 it requires just as simple filling of a very straightforward & self explanatory form ...... if he is lazy  ;) fill it up for him then all he needs to do is sign it.

You need to attach the original Form 16 along with you return to prove TDS has been provided for.
Yes every person can file its return of income. Form 16 as per I T Act has to be issued only when some one has the taxable inocme. Fo9r 16 is a certificate. For NIL a certificate can not be issued. In lieu of Form 16 the person shopuld arrange a salary certificate form the employer and on the same basis he can file his return . :P
