Form 16

I am working as a Teacher with the institution in Mumbai since last 1year, I want to apply for Home loans, My company can provide me ith Salary certificate but they are not providing me with form 16, also i am getting 35000 salary in cash, please help

The employer is under an obligation to issue Form 16 under section 203 of the Income Tax Act, 1961, if he has deducted TDS and deposited the same to the credit of the Government.

There is no reason for non-issuing of Form 16 in your case.

Your salary is mandatorily chargeable to TDS. Whether they have deducted any TDS ? If yes you can claim your Form16 for the amount Deducted.

As said by Swaroop ji, your salary is liable to TDS u/s 192B. Therefore, when TDS is deducted it is mandatory for the deductor (ie. the Employer) to issue Form 16 to the deductee ie. in your case it is to be submitted to you.

Total Salary Rs. 420000 (Rs. 35000 x 12 months). The basic exemption slab for Women below 65 years is rs. 190000. As your salary is above the basic exemption limit, so your salary is liable for TDS.
