Form 16

If the date of Form 16 is prior to 01st May, 2008, since it is to be issued immediately after the closure of financial year, the new director can not sign the form. Since there will be another director, presuming a continuing director, since minimum number of directors required is 2, the other director can sign the form. Also if any other person who is in charge of taxation, can be authorised to issue the form 16 and sign on behalf of the company.

Form 16 can be issued by any person authorised....whether a Director or a person specifically entrusted with the responsibility... it has nothing to do with date of appointment.
