Quick Summary
This discussion explores the tax implications for Indian companies operating a foreign branch, such as in Dubai. It addresses whether losses incurred by the foreign branch can be claimed in India and if profits generated abroad are subject to Indian taxation. The advice suggests this depends on whether the income accrues or is deemed to accrue in India, with a note on POEM guidelines and potential exemptions.

It will depend on whether the income of such foreign branch accrue or deemed to be accrue or arise in India.

Yes, POEM of the branch will be in India. However, CBDT has provided exemption to companies having turnover of 50 crores n F.Y from the POEM guidelines
