Filing of it return for ay 2010-11

I am an individual and got all TDS for the income in AY 2010-11. I was not able to get my Form 16 and therefore wasn't able to file my it returns in time. Finally when I have got a hold of it and my tax to be refunded is Rs. 9,600, the IT dept. says the last date for filing the return is over.

But as far as I remember, I could file my returns even 10 years post the AY if I didn't have any tax liability. This is really not right. I mean I don't have any tax liability for AY 2010-11. The system should allow filing and refund of IT.

 IT Return should be filed either with in due date or with in one year from the end of relevant Assessment year, to claim refunds.

so in ur case the last date to file return will be 31.03.12, which u failed to file.

U can file returns if u dont have tax liability at all( No tax paid and no Tds deducted) if u wish to do so.

but in ur case u r telling tds is deducted on your income, so you have tax laibilty ryt. then may be u lost ur chance to claim refund.

However, this new rule of filing has only emerged in July 2012 and prior to that it was 5 years. I am a salaried employee and get my pay only post TDS, it sounds unfair to people belonging to this category who have no hidden source of income or black money and the system takes away the right to claim their rightfully earned pay just because the form 16 got misplaced and therefore there is delay in filing.

I am running this past thru several IT consultants since morning and all I get is a blank "NO". I suggest that the IT Dept. should allow late filings on case to case basis based on the autheticity of reason. Its not about the money but about the system and people's trust in the system. Just because TCS cannot make systems which can help file last 5 years returns, the intention of the system cannot be comprised based on a rule which has come out this year itself.

Anyways, what I am looking for is alternatives. There has to be a way to file this return. Thank you for your support.

definately u will find a way!! i can understand your concern. laws are only for the guys who only follow. it seems u need to break rules

 

smiley I'll take your comment with a smiley...but I am a rule abiding citizen...however there is always exceptions to the rule. People busy in jobs find IT returns filing a distraction and keep it low on the priority till they have lost significant time and pay in it. I just say that IT Dept. should be more empathetic to guys like us...and open the filing window for a longer duration...or show another way...
