Filing of form 23b

Dear All,

With regard to my 1st question we have taken a resignation letter from the previous auditor of the company and now My question is that, we will file Form 23B for appointment of new auditor of the company, but resignation of the former auditor of the company would reqiured to inform MCA or not. If yes then, What is the procedure?

Please suggest.

No.

There is only requirement to file Form 23 B with the concerned ROC, if the business conducted duing EGM was an ordinary business. Means for passing any ordinary resolution, the company need not file Form 23 and hence not the resignation letter. So a simple Form 23 B will be suffice for the purpose.

WHETHER FILING FEES OF FORM 23B PAID BY STATUTORY AUDITOR IS REIMBURSEABLE FROM THE CLIENT

See Mr. Nikhil, as per my opinion if the fees paid by Auditor it is reimburseable, because company can claim that as their expense.

Nice Discussion.............
