Extra TDS with malicious intention

Hi ...i just realised my previous company deducted Rs.184000 as TDS in my December 08 month payslip which was a final settlement also.

In the form 16 they have given me they have only paid IT department only Rs.125000 for the month of december. (All other months tally on the paid amount)

I know for sure someone in the finance has pocketed this money. Given the amount of trouble they had given me in final settlement, its not going to be easy for me to get the money out from them.

What is it now that i can do??

1) Will IT Dept refund me the extra TDS or not (given that employer has not declared it correctly)?

2) Where can i file a complaint against the employer?

3) What's the penalty/punishement/fine employer gets slapped with?

4) Advise me on what to do!!!

Eagerly awaiting some advise on this. Please reply.

Hi sid,

Did u check ur view tax credit in the I.T. website... how much TDS got deposited against ur PAN... U will get the credit of TDS for what is being deposited in it only.. pls check that first... whether the Company has filed it TDS returns correctly... did they mention the correct amount in the FORM 16 issued to u... ?????

Hi Anurag,

Yes i have checked. The company has deposited less tax and deducted more from my payslip. The form 16 also shows deposit through cheque an amount of 1.25 lacs while they deducted almost about 1.85lacs

Hey SID then u can recover it from ur employer.

If u have TAX Liability of Rs.185000 then u have to deposit that amount in Income Tax.

otherwise it is ur money u have a right on that income u can sue ur employer for pocketing ur money if they r not paying Tax out of it.

You should actually claim it from the company...

see the top management with all the documents,,,, its not a small amt that u can forget....
