Extend DEPB Till GST Launch: FIEO To Govt

 

The Federation of Indian Exports Organisations (FIEO) today suggested that the 14-year-old Duty Entitlement Pass Book (DEPB) scheme be extended till the Goods and Services Tax (GST) is introduced in the country.

"The DEPB scheme should continue till GST is introduced as it will not possible to fix the drawback rates for all the products for which DEPB rates exist in the short span of three months," FIEO President Ramu S Deora said in press statement.

GST, which was scheduled for release from April next year, may now not be possible as the government has been unable to secure the consent from all the states.

Deora said the government should issue a notification on the same so that the uncertainty regarding extension gets over.

"In the long run government should definitely bring all products under the All Industry Duty Drawback Scheme and should also involve industry bodies in fixation of the rates for accuracy of the data and transparency in fixation," he said.

The Centre today extended the DEPB scheme, which was supposed to end on June 30, to upto September 30 but exporters urged the Finance and Commerce Ministeries to extend it further.

Under the scheme, exporters are given refunds of tax incidence on the import content of their export products. The scheme is the most popular among exporters, especially in the engineering sector, including automobile industry.

Applicable Rate Of Taxation On DEPB Under Haryana Value Added Tax Act, 2003


"Incorporeal or Intangible goods" appear at entry no. 38 in Schedule C of Haryana Value Added Tax Act, 2003. The taxability of items appearing in Schedule C is provided in Sub clause (iii) of clause (a) of sub section (1) of Section 7, which providing for the rates of tax states that  7(1)(a)(iii) - in the case of goods specified in Schedule C, shall be calculated at four percent or such other rate not exceeding ten percent as the State Government may, by notification in the Official Gazette, direct ;
As no notification has been issued in respect of rate under the provisions of above section. The applicable rate of tax is 4%.

Thus DEPB is taxable at the rate of 4% under the Haryana Value Added Tax Act, 2003.

GST stands for Goods and Service Tax. It is a comprehenseive calue added tax. GST is collected on the value added goods and services at each stage of sale or purchase in the supply chain.

sir pls can yu clarify my doubt regarding DEPB n GST

WHEN YOU SELL THE DEPB LICENCE AS PER PROVISION LAID DOWN IS  STATE SALES TAX DEPARTMENT WILL IMPOSED THE VAT (SALES TAX)  AND IN FORTHCOMING PERIOD GST WILL BE IMPOSED SHORTLY AS PER GOVERNEMNT DECISION .

IT WILL REPLACE OF SERVICE TAX AND VAT ALSO.
