Exporting USA made goods from India Back - Applicability of Trump's new Tariff.

I am a trader based in Mumbai and I regularly purchase goods from Indian customs auctions. These are typically imported goods that were stuck in customs (due to non-payment of duties, wrong declarations, under-invoicing, etc.) and later auctioned. Recently, I bought a consignment of electronic goods at auction which are manufactured in the USA (country of origin: USA). Now, I plan to export these goods from India back to my buyers in the United States. From 27th August 2025, the U.S. Government under President Trump has announced a 50% tariff on imports from India. My concern is whether this tariff will also apply to my shipments, since: The goods are U.S.-made (manufactured in USA), They were stuck in Indian customs and later bought by me at auction, and I am now re-exporting them to USA without any modification or value addition. My Questions: 1. Will these U.S.-made goods, when exported back to USA from India, attract the new 50% Trump tariff? 2. Can these shipments qualify under the “American Goods Returned” provision (HTS 9801.00.10) and enter the USA duty-free, provided I furnish the required documentation? 3. What documents should I prepare to ensure smooth clearance in USA customs? I would be grateful if experts can guide me on the correct legal/tax position and the practical approach in this situation.

Tariff applicability: Since the goods are U.S.- made and were stuck in Indian customs due to issues like non-payment of duties, they might qualify for duty-free entry under the " American Goods Returned" provision if proper documentation is provided The new 50% tariff on imports from India might not apply if these goods qualify under this provision. 

2. "American Goods Returned" provision  : Yes, these shipments can qualify for duty-free entry if you furnish the required documentation proving the goods were manufactured in the U.S. and are being returned without modification or value addition in India. 

3. Required documentation : To ensure smooth clearance in U.S. customs under the "American Goods Returned" provision, you'll typically need:

Proof of U.S. origin (like a manufacturer's certificate or export documentation showing the goods were made in the U.S.)

Documentation showing the goods were in India due to customs issues and weren't modified or value - added while there. 

Proper customs forms and declarations for re-importation into the U.S.
