Export within india

Dear Experts,

We are talking about a situation wherein we have received the Purchase Order from a company in Malaysia. We are registered in Delhi and our customer from Malaysia is not registered in India. They are working in Haridwar for an Indian company and they want us to deliver the ordered material at Haridwar. We have received the payment in USD by swift transfer. The Indian company for which they are working has agreed to give us the Road Permit from Delhi to their unit in Haridwar. We will raise our invoice on the Malaysian Company. So, in this case, kindly advise whether this will be treated as Export? And what tax will charged from our Malaysian Customer?

Dear Sir 

As per the definition of export (as per custom act) we cannot classify this as Export. 

(when goods are sent from indian territory to any place outside india then it can be said as export.)

Invoice in dollars and recieving amount for the same does not make any difference and i suggest you to classify it as domestic sales and not as export sales in your books.
