Excise rate applicable for differential price

Dear Friends,

kindly clarify the below query.

In a sale of goods, If there is an increase in price with an increase in rate of duty too from the price and duty rate applicable at the date of removal of goods, whether the excise rate applicable at the date of removal would be applied or the rate applicable at the date of increase in price would be applied for paying the differential duty. 

 

Pls consider the below example.

on 1.1.10 x sold 10 kgs @ rs.20 with excise rate of 8% , on 1.4.10 the rate has been increased to rs.22 for those sold on 1.1.10 and the excise rate on 1.4.10 is 10%.  differential duty amount would be calculated on 8% or 10%.?

In both condition you are liable to pay Excise duty at the rate of 10%. Transaction value is relevant for valuation only when goods are sold at the time and place of removal. Date of increasment of excise duty will be count also.
