Excise duty refund for trading companies

Hi,

 

We have a query based on Excise duty refund. Is there any provision for excise duty refund for Trading companies?

 

This is how the scenario would be: We are a trading company having central Excise registration. We paid excise duty to our supplier but we do not collect it from our buyer who is a manufacturer. Is there anything like we can get refund of excise duty if we show pollution board certificate of the manufacturer which proves that they will use this to manufacture a product which would be exciseable? Thanks.

in all cases you have to issue bills to your client, "inclusive of duty"

you have to issue cenvatable invoice to only those clients who are regd with excise, for pass on of duty paid at factory, for others the duty is deemed paid in your value.

you have no option to charge to customer / but you can pass on only, 

similer way you have no right on the duty part, so claim does not sustain.

Trading company registered with excise only can pass the excise duty to buyer.  They can't claim refund of excise duty.
