Respected Sirs,

Please help on a query.

if a person who is a trader of Iron & Steel Products and trading turn over is 85 lacs & also doing Profile cutting of M.S. plates which is a product of  Iron & Steel (Turn over of the profile cutting is included in 85 Lacs) & wants to registered him self under excise to pass on cenvat as a first or second stage dealer. is that possible?

The second thing is that does profile cutting activity considered as manufacturing  if yes does it attract any excise duty or does the excis applicable to the dealer who is registered under excise if  the total turn over of trading activity & profile cutting of m.S. plate does not exceeds 85 lacs in any conditions?

Can a trader keep excisable stock for trading in WAREHOUSE & do profile cutting in his premises where excise registration is not taken? If yes does profile cutting attract excise duty?

looking forward for your help & material of excise department for the above subject if any.

Regards

Ashish Shah

Excise duty is levied on the manufactured goods. As per your query, profile appears to be a menufactured product. Trader can deal in traded goods and can also engage in the manufacture of goods.. Trading is not allowed in manufactured goods of the company itself. Excise duty is exempted upto the turnover of Rs. 150 lakhs. Trading is not included in the turnover of exempted goods.
