Quick Summary
If your employer deducted TDS but failed to deposit it with the Income Tax department, you might receive a demand notice. You can respond by uploading your Form 16 to the IT department. It's also advisable to check with your employer directly to ensure they deposit the TDS and file the necessary returns. If Form 16 isn't forthcoming or the TDS isn't reflected in Form 26AS, consider obtaining salary slips, getting them signed by your employer, and lodging a complaint with your Assessing Officer.

In demand raise ..u can give response to IT dept..by uploading your form 16.
Do you have Form 16 issued by your employer which shows the amt of tds deducted from your salary? and have you claimed as per form 16?

You should check with ur employer as well and ask him to deposit the TDS & file the TDS return
How can one get a form 16 when the deductor didn't deposit the tax to the govt account. Get the salary slip showing your tax deduction and get it signed by your employer and meet your AO and make a complaint against your employer.
I have seen situations where the tds certificate has been issued but the tds amt is not reflected in form 26AS....so just checking....(issue of fake tds certificate)
