earnest money dd lost

hi frnds can anyone tell me if a emd dd is lost by the party , how it get credited back in our acccount. Actually we had issued a dd on 10/12/2004 as a security , the same is not credited in the party account, so how we claim this amount. only we have photocopy of this dd
