Dvat cancelled due to filing nil returns

DVat 2710 views 1 replies

The DVAT was registered on 28 march 2013. Being a start up the company did not have any sales and hence nil return was filled for two quarters of 2013-14. It is likely to be nil for sometime.

A show cause notice was given in the dvat website for filing nil returns for at least one year. The notice was not send by post nor any e-mail or communication was send. As per notice dealers had to appear by Dec 30 2013 for explanation. Subsequently notice was given in form of excel sheet in their website notifying cancellation of registeration. This notice is not there in dealer log-in portal.

However status as per dealers is being shown as registered. In the cancelled dealership the dealers name is being shown.

What are the steps the dealer can take in order to file an appeal or get registeration restored?

File a reply with DVAT Deptt giving satisfatory reply of filing NIL Return. On filing the reply most probably the deptt will not cancel registration.

If deptt still cancels the registration, objection can be filed u/s 74 within 2 months from the date of service of cancellation order.
