Doing business with foreign company

Hi,

I have a registered proreitorship company in India. It provides Software consultancy services. i have got a customer in South Africa. Can i send invoice directly to South African customer? i believe so it is possible. If yes, what are the service tax implications. i have registered for service tax number in India. Do i have to follow any other procedures to send invoice to a foreign company. At present i am getting money like salary in South Africa. But tax rates are very high over there (36%). Moreover as it is treated as salary, i can not claim tax exemptions on many things.

Inputs from CA's would help me in making right decision.

1)right now you are employed in SA and getting salary there 

2) you have a propritorship company in india who is providing software services , regd with service tax also

3) you have provided services to SA party from indian company and want to submit bills , and want to know about taxes....

share your Residencial details, i.e how many days you have been in SA / india in previous 3 years and at present your location and period of stay

You can send the bill directly to your S.A customer. Being export of service, service tax is exempted provided payment is received in foreign exchange.

I have been in South Africa since November 2010. I wil be there till end of this month. I have paid tax there. I know that if stay in foreign location is not more than 6 months, then tax has to be paid in India for that income also. But its too difficult to do tax calculation for foreign income and INdian income in India. For this i have to get in touch with big firms like E&Y in Bangalore for this. because small audit firms do not do this.

Brother your CA should have enthusiasm to handle the task.

Moreover Your Status in India is Resident and you are liable for tax on income earned also in abroad also. However as per DTAA agreement with South Africa you will get rebate on tax paid in South AFrica.

 

Status in India is From November 2010 to 31 March 2011 would be considered not July 2011

And to the extent i Know the Financial Year in South Africa is JAn to Dec.

But Tax rate in South Africa is Same as 30% as per my Knowledge

 

 

 

Would you give me the exact Country name Like Ethoipia also lies in Africa

 

You CAn Also get rebate on tax paid in South Africa even if there is No DTAA  with the respective Country

Thanks a lot for your reply and valuable inputs. I am working in Cape Town. i will be here till end of this month. Here tax rate goes up to 40%. Do you know anyone in bangalore who can handle my tax calculation considering my international income?
