Divorce related...

Experts in family, kindly guide.

One of my friend is going through a rough time in his marriage. The girl has left his house and not ready to come back since months. She is asking him to return all her belongings but not ready to give clarity of whether she wants to continue in the relationship or not! In one of the fights, the boy had raised his hand in her after she pinched him with her nails, so basically it was provoked by her. On financial terms, the girl is earning much more than the boy.

My query is, can she seek alimony even tho' she files an IT return of almost double than the guy? Also, can she get the domestic violence angle to the court if they go for divorce and seek alimony on that basis?

In my view she can demand for alimony but will be determined after assessment of the boy's income that too full alimony may not be given but half of the determined amount may be given as she is working . There is no role of IT return.

This is purely my personal view .
