disqualification of director

Sir After Incorporation of a PVT Ltd company can the directors who incorporated can resign immediately after the Incorporation or there is any time prescribed to be as directors ???

As per section 164(2) if the Companies fails to file the Annual return or financial statement for the continous period of 3 financial year then the office of the Director become vaccated as per provisions of section 167

For Example if default is for financial year 2013 to 2016, then such a person cannot become the Director for next 5 years i.e. till year 2021.

As per the provisions of Section 167 the person who incurres disqulaification under Section 164, his office shall become vacated.
