Director has multiple DINs. both o them used ..and he is the director of separate companies under these two DINs..it's not possible to file DIR-5.. what is solution in this case?
Need to File RTI that how MCA issue two din against same PAN, definitely there is any issue. First make changes in din of the respective companies of which you want to file DIR-5 to surrender your DIN.
As per rule 11(f), a person can apply for surrender of DIN only in the situation when “DIN is unused and never used for appointment as director in any Company” (except situations like unsound mind, death, and insolvent). in this case DIN is used, how can file DIR-5
The Central Government or Regional Director (Northern Region), Delhi or any officer authorised by the Regional Director may, upon being satisfied on verification of particulars or documentary proof attached with the application received along with fee as specified in Companies (Registration Offices and Fees) Rules, 2014] from any person, cancel or deactivate the DIN in case:
a) the DIN is found to be duplicatedin respect of the same person provided the data related to both the DIN shall be merged with the validly retained number;
You need to consult in MCA department to merge the same. No more options.
