Any person wishing to surrender a DIN can file Form DIR-5 with the MCA but in Form DIR-5 mandatory to check the icon "further declare that I have never been appointed as director/designated partner in any company/LLP and the DIN has never been used for filing of any document with any authority." my question is that Any person wishing to surrender a DIN and previously he was a director in a company then he can not file Form DIR-5 with the MCA and not surrender a DIN....what is the solution for this irregularity in the Form DIR-5.

Its simple rule. a person can not surrender his or her DIN if he or she has been a Director in Company / DP in LLP.
