Din for foreign director

Hi, 

I am working in MNC which is 100%  subsidiary of the foreign Company, hence 50% of the Directors are foreign Nationals . 

As per New DIN rules affidavit of the applicant has to be  on non-judiacial stamp paper and same has to be notarised. 

Now, in our case Foreign Directors are non- executive who hardly visit India  . 

Please let me know if there is any way out to the provision  relating to notarisation of the Affidavit.

Attestation Requirement
Photograph, identity proof and address proof needs to be attested by notary public, govt. gazette officer, practicing CA/CS/ICWA etc. In case of a foreign national, the photograph, identity proof and address proof should be duly attested by the notary public/Indian embassy/ apostille authority in the home country of the applicant.

 

What are the additional information/ documents required in case of a foreign national? 

Details of a valid passport should be filled in form DIN-1 and a certified copy of same should 
be attached with DIN application. All supporting documents including photograph should be 
certified by the Indian Embassy or a notary in the home country of the applicant or by the 
Managing Director / CEO / Company Secretary of the company registered in India, in which 
applicant is a director.

Thanks for your prompt reply but as per latest DIN rules affidavit of the applicant which is one of the mandatory attachment has to be on Non- Judicial Stamp paper of Rs. 10 and same has to get notarised. Now in my case , Director which is foreign national will not come down to India as anyways he is non-executive director.

I understand that Notary can not be done in the absence of the Director, Now I just want to know that there must be hundreds of  Company who must be facing similar issues, what way out they are opting for obtaining DIN for such Directors. 

 

Yes...I agree...but taking it as a practical view....the affidavit is required to be notarized in their country only..not in ours

Well, I faced the same problem while incorporating foreign subsidiary.

 

I contacted DIN cell and they told me that affidavit requirement on stamp paper is compulsory for Indian nation person only.

 

For foreign nation person can take a print on plain paper and get it notarized by their country professional and stamp the same at Indian embassy of foreign country.

 

That will be sufficient compliance.

 

P.S

Every document of foreign country/ foreign national person has to be signed and stamped by Indian embassy of foreign country.
