Service tax audit by department

on 7th April'16 we got a call from our CA that we have a service tax audit on 11th April'16 from department but according to my knowledge, department always give 15 days prior notice before coming for audit that is also after giving intimation. They are coming to our registered office that is in Delhi. can somebody please write a correct procedure to be followed by department

Hi,

Dept people won't act neither per our will or nor follow rules. Service Tax Dept officials are best example for that.

If you try to question them, they will try to hit you back hard asking too many documents which will create a mess !!!!

I would suggest you to b prepared !!!!

Immediately write a letter stating that 15 days time is to be provided. Therefore request them to come by a date conveneint to you. Send by RPAD/ Speed post.

Please contract the audit team and say your problem to them. Generally they listen the assessee and fix date of audit as per convinence of assessee.

Nidhi Raina ji, as you yourself declared that your C.A. has intimated you that have a service tax audit on 11th April'16 which shows that the department might have informed your C.A. well in advance and your C.A. subbsequently intimated you, may be at later stage. As per STR, at the time of registration in service tax, assesee is required to mention their email ID and Deptt. can sent intimation to that email which is also valid. It appears that in your case, you mentioned email ID not yours but of your C.A. otherwise, how your C.A. know?

Also, Audit Officer intimate probable date which is convinient to them as per their planned schedule, but on your proper submission, suitable time is being given to prepare information required for audit and also suitable date for audit can be decided at the convinient of both side.

It is advisable to mention your email ID instead of your consultant.
