Dear Experts My mom have got intimation from income tax deptt u/s 143(1). My mom is having source of income just from the interest on FDR. As initially my mom had no PAN so the bank deducted tax on interest @ 20%. later on she applied for PAN & submitted it with Bank. so they asked that they will provide manual statement of deduction of tax @ 10%. But the bank didn't provided that till 31st july & not even after that. So she filed ROI declaring income of Rs. 192340 though she had not that much income. As the return had not been revised u/s 139(5) till date & she have received intimation u/s 143(1). so my question is whether now ROI can be revised claiming the refund of tax deducted on interest income Plz reply urgently. Thank you so much.

Original return was filed before due date u/s 139(1) i.e 26-july-2014. Plz reply thank you.

Don't worry, You can still revise you return under section 139(5)

and claim tds show the TAN of bank and name of bank

Hello, Neha

Basicly Return can be revised only, one year after the assesment year or completion of assesment which ever is earlier (if return is filled within due date)

Hence it cant be revised because u had recived the assessment order..143......

Secondly, You  cant also go for section 154(rectification) because you had not claim tds amount in original return.

So forget Tds amount dear, now their is no way to get refund for tds

Thanks

Hello Shikhar it is an intimation u/s 143(1) not an assessment order. I guess assessment is done u/s 143(3). So here iam confused whether return can be revised and refund can be claimed of tds. Thank you.

You can revise the return after intimation u/s 143(1) and claim TDS refund

Thank you everyone for your reply.

ofcrse you can revised the same mam ...dont worry get the correct details from bank and revise return under section 139(5).

There is no need to worry..

Do i need to first reply of intimation u/s 143(1)?
Not required. Just revise the return with complete details of TDS.
