Deemed let out or vacant property

Dear friends,

how does one decide is the house left vacant for the whole year or is it self occupied property and is to be treated as deemed to be let out??

Example: Mr.X owns to two houses A and B
House A has been self occupied by Mr.X during the previous year 2012-13
House B has been not used throughout the year.
Mr.X contends that the house B is to be treated as "Let out propert vacant through out the year" and Not as deemed let out property!!

So my question is whether the House B is to be treated as "Let out property Vacant through out the year" or "Deemed let out property" for the purpose of Computation of income from hosue property??

The tax implication will be different under both the alternatives as Annual vAlue will be nil if it is considered as let out property Vacant throuhout the year.

only one house property can be taken as self occupied and other properties if any even if it does not let out should be taken as deemed to be let out as per IT ACT.

How to find the amount for "deemed to be let out" property? Any guidelines available? For eg, if actual rent of a similar house in the particular locality is Rs.10000/- what would be the value of the deemed to be let out property? Rs.10,000 or a % of that (since there is no actual income).

Use which ever is higher for: Municipality rent v/s fair rent   (Part A)     (Fair rent is similar property)

Use which ever is lower for: Standard rent v/s (part A)

If a property is let and was vacant during any part or whole of the year and due to such vacancy, the rent received is less than the notional rent, such lesser amount shall be the Gross Annual Value.

The vacant property will be treated as deemed to be let out or SOP whatever owner wants to if it is let out for even a single day during financial year then it will be treated as let out property
