Deduction u/s 80 c - tution fees

A person has paid tution fees of Rs 500,000 during the FY 2011-12.

He claims Rs 100,000 u/s 80C in his retrun for tution fees. and his wife also claims Rs 100,000 in her return for tution fees  out of total expenditure of Rs 500,000.

 

Can they do so ???. If possible, pls mention the relevant text also.

if both mothr,father are earning person & filed there incometx return then they claim 100,000/- T.fee deduction sapratly.

As per my knowledge, the Tution Fees can be claimed as deduction by the person actually paying it. 

For Eg : If the payment is made through husband's bank a/c, then he shall be eligible to claim the deduction and if it is paid through wife's bank a/c, then she shall be eligible.

yes devendra u r right. if mother / father paid t.fee sepratetly then the claim 80c in his/her return sepratly

but only one person paid all t.fee amount then only that one claim. please note the word T.FEE  in mind not include donation,fund etc.only T.fee amount we claim.
