Declaring Gift (Money) in ITR

Hello! I have 2 queries regarding gift (money) that I am seeking help in order to file my latest ITR:

  • I have received gift from 2 of my friends (via UPI) that comes down to a total of 45,000 (under 50,000). I have researched that under section 56, gift received from friend under 50000 is non taxable so I wanted to understand how to declare that income in my income tax return.
  • I have gifted my mother 1.5 lacs (via cheque) directly into her PPF account from my savings account in August 2022 so how can I show that I have gifted this amount to my mom under tax saving instrument? I am aware that money received and sent to parents is tax free but how to declare these things in the ITR?

I always fill ITR 4 under presumptive scheme (Section 44ADA). I cannot put 45000 under income from other sources because then it considers it income and makes it taxable. There is also a section for disclosure and exempt income but any amount entered there doesn't reduce the net income in my ITR. How to go about this, please help me! Thank you!

1. The gift received by you can be declared under exempt income.... Schedule EI.

2. Gift given to your mother cannot be declared in your ITR.

Thanks for the reply sir! But when I enter 45000 in Schedule EI, it doesn't reduce the total income and total tax. Shall I subtract that amount from "income from other sources" field and only put it in schedule EI? Also what category shall I select in Schedule EI for gift received?

You don't have to declare it under IFOS. Only under Exempt Income.

Under Others ... Gift from friends.

Okay sir I got it now, so basically I don't have to add that amount into any of the income categories (profession/other sources etc) and only put it in exempt income.

I have similar query on gift received from father.

I received some jewellery and money as gift from my father during FY 2022-23. I am salaried person and had already filed ITR 2. Do i have to file revised return disclosing the gift details. If so kindly share how to go about it.

No need to revise the return now, but keep gift deed ready in case of future inquiry, if any.

Is there a provision to declare the gift given to a relative in ITR ? 

There is no provision to declare it in ITR of gift donor. Only gift (from Relative/s) receiver  can declare it in Schedule EI of ITR.
