Dear Sir,

If the death of director of the public company occurs, whether there is a need of intimation of the event to ROC.

Company has sufficient minimum no. of directors.

Pls guide.

Dear Mohit, when ever a new director comes into the organisation or existing director leaves the organisation either through resignation, death, or removal of director had been carried on, an intimation is required to be given to the concerned ROC by filing E Form 32 stating the reasons. In your case, Death Certificate is required to be attached and to be filed with the ROC

evey change in directorship of the company should be intimated to registrar within 30 days

Dear Mohit,

 

It is very much advisable to file form-32 with ROC within 30 days of death of director to update the list of director in ROC record.

 

In forn-32 you have to select cessation of directorship due to death.
