Dealer's credit passing

Case:-

'P' agency is a dealer in gas, registered as excise dealer. Passes credit given by the Hindusthan Petrolium Corporation Limited to its sundry debtors or customers who are registered under excise.....

If in case it sells the goods to a non registered cutomer whether it need to issue excise invoice to him by passing exice credit to the un registered customer???

If buyer is not registered under central excise then no need to issue cenvatable invoice to non-register unit. Only you can issue invoice without cenvat credit. 

Then what about the credit we got, that will remain unutilised at stock r8??

Dear Shrinidhi,

No excise invoice needed if you are selling your product to unregistered customer.

Accordingly please write off the credit if any shown in books.

You can accordingly include in your cost element and issue a commercial invoice insteadof Excise invoice.

Can we issue excise invoice??. We can issue excise invoice r8??. If they got registered,they will utilise it...
 

yeah , According to excise provision do not restrict you from issuing excise invoice.
