for notice of AGM there should be 25 days before meeting i.e. 

1 day date of meeting

1 day date of posting

2 days for letter in transit

so as per the above mentioned there must be 21 clear days before the date of meeting and date of notice

for conducting AGM the earlier of the below is considered

An AGM must be conducted with in 6 months from the close of financial

there should not be more than 15 months gap between two AGM' s

There must be one AGM for every Financial year

the above conditions are for a company where's its AGM is other than the First AGM

how ever the ROC may allow a maximum of 3 months time in case of default under certain circumstances only

3cd relates to income tax Act and the last date was sept. 30 every year as per the current year provisions
