From 1st April'10 - 31st Dec'10 I have worked in one company who is neither deducted my TDS nor issued me Form 16.

1st Jan'11-31st Mar'11 I have changed company & present company deducted TDS of Rs. 7001 during this 3 months & issued me Form 16 mentioning total Income from Salary is Rs. 62250. I dont file IT return for this year.

But now somebody tell me that the if I filed IT returns of FY 10-11 I can claim the refund of Rs. 7001 because as per Form 16 my total income is Rs. 62250 which is tax free.

1) Shall I filed Return now ?

2) Will I mention my total Income during the year is Rs. 62250 ?

3) Any interest is payable for late filing of Return?

4) Shall I claim the Rs 7001/- as refund ?

As per section 139(4) of Income Tax Act, 1961, you could file your belated ITR for F.Y. 2010-11 by March 31st 2012, which si alreday gone, therefore, it would not be possible to file your ITR now for this year, however, you may still try to file your ITR manually with your concerned AO and request your AO to kindly allow you to claim refund, then may be you would be successful to claim refund of your TDS. The electronic filing of this ITR would not be workable.

I hop, you are filing your current year's ITR timely by July 31st, 2012.
