Consent of principal for industrial training

I am in my second year of Articleship and now want to undergo Industrial Training in the third year. I served the intimation to my Principal for my plans of Industrial Training. However he refused to accept it. He says that he wont sign on Form 109 (Termination of Articles) before the completion of Three years. However the Regulation 51 of ICAI says that  an articled clerk may, at his discretion, serve as an industrial trainee.

I want to undergo Industrial Training and I have even informed my Principal before 3 months(as per Regulations 51). Can he stop me from undergoing Industrial Training. Can the Institute help me?

Nobody can stop u from doing industrial training if u complied with the rules and regulations..

u can write to institute abt it and can express your complain regardin it..

 

Yes agree with Sumit Sir s advice. You have right to go for the Industrial Training. No one can deprive you of your rights. But complaining to Icai is bit risky as its your career after all. First, Try to request your principal and convince him for this. And if he still refuses then do complain about the matter to Icai officials. But make sure that you have not availed any excess leaves. Make sure you have signed the attendance register at office regularly. Good Luck. Take Care.

I tried convincing him, but he says he does not have enough articles to complete the work. I guess that is the reason why institute have asked us to serve 3 months notice so that he can arrange for a replacement. I am confused about what to do.

If he doesnt have enough articles to complete his work then it is not your problem. You are not his servant. He is only seeing his self interest and not your career growth. Its your career above all. I understand your situation. Even i have done my articleship under a similar selfish unprofessional CA. You have to use other means now to make him allow you for industrial training. Good Luck.

Thanks for the reply. I had been t the institute for the same, but the counsillor said that the institue wont interfere in this matter. He said that I have to convince my Principal for allowing me to undergo industrial Training. Though he said that i can drop a complaint in written. I did that. Will the institue take any action against my Principal for forcefully not allowing me undergo Industrial Training??

The same is my situation now.

The CA under whom I got registered as a trianee is not approving my termination.

How to give a complaint and to whom should I?

Suggest an appropriate authority that'd consider my grievance to my favor.

yash, you better send a written notice to your principal 3 months prior to the date of commencement of Industrial Training and also talk to him.

It is at your discretion to pursue industrial training. He is no one to stop.

But you should be able to convince him so that he shall sign on your termination form.

What if he says to leave the office immediately ???😥😥
Are we supposed to give intimation in writing or just a oral communication is enough. Because I have also already intimated my principal about my plan. Now he is refusing to leave me.
