Can anyone tell me the tax treatment in the following situation - 

  • An Indian is employed by a Hong-Kong Company
  • He will perform his services in Bangladesh, the company where he will perform his services is the third party
  • Salary will be credited by Hong Kong Company directly in his Indian Account.
  • The company where he will perform his services is near to the India-Bangladesh Border so he will stay in India with his family and go daily to Bangladesh for work.

Since his salary is credited in his indian account, tax will be applicable as per indian law and he resides in India, he is an ordinary resident.

he stays in India he is a resident ......therefore such income shall be treated as deemed to accrue or arise in India and shall be taxable as per indian law
