Compliance certificate

Co Act 2013 1539 views 2 replies

In New Companies Act, 2013, power of Compliance Certificate is withdrawn which will lead to

---loss of around Rs. 20 Crore to MCA for non filing of Form no. 66

---loss to Company Scretaries in Practice of Fee around Rs.25-35 Crore that means average loss of Rs.50000-400000 for each CS in practice annually;

----leaving 4-5 metro cities where CS can provide services in the field of amalgamation, CLB, CLT, CS in practice will become mere filing agents

---- CAs and cost Accountants have given power of audit certificates and power of CS has been withdrawn only;

----New CS will have role in listed companies only

If I am wrong, Pls. comment.

Yes you are right absolutely.

There is big loss MCA as Compare to Practicing Company Secretary.

As in new Companies Act, 2013 Certification of Annual Return by Practicing Company Secretary has been made Mandatory to prescribed class of Companies i.e. Small Companies and other.

There is big loss to MCA and PCS but in other way PCS have authorised for Annual Return Certification also.
