If someone forms a proprietary firm with the name 'xyz IT solutions' then can some one form a partnership firm with the same name?

It means there is a great risk of loosing the business. If someone forms a proprietary firm with name XYZ IT Solutions and if the firm becomes popular, then to cash the popularity, other people can form a partinership firm with same name.
