Companies Act 2013 requires all companies including private companies to obtain Certificate of commencement of business.
From which date are these provisions applicable to a private limited company?
Whether forms for application for obtaining Certificate of commencement of business prescribed?
Dear Rashmikant,
This provision is provided in Section 11 of the Companies Act, 2013.
On 12th September, 2013, 98 sections of the Companies Act, 2013 were brought into force. Section 11 is not included in list of 98 sections notified by the government. Hence, as of now, a Private Limited company will not require Certificate of Commencement of business unless section 11 is notified by the government.
