Clarification for Leave Travel Concession

I have doubts in eligibility basic exemption conditions, calculation of Leave Travel Concession (U/s 10(5)).

1. Employee can avail/claim travel expenses only or boarding, lodging expenses also?

2. If employee can take package of tour from travel agency, it can eligible to claim? (Example: so many travel agencies providing tour packages, in this package including service of travel/boarding/lodging/other charges)

3. Tour/travel limited to India or foreign tour also permitted?

4. Expenses incurred more than the employer proving, eligible for claim? Example: XYZ Rs. 50,000 LTA received (this amount under salary package, he is receiving month wise) from employer for the period of 2 years, but expenses incurred in LTA travel Rs. 60,000l, he is eligible for exemption more than the received amount?

3. Travel is subjected to only in INDIA not FOREIGN Tours. 4. No the employee would not be eligible for exemption more than amount received. 1. Employee can only avail for expenses subject to travelling only.
Please advice me, it is urgent for me, i mean in my organisation so many employees claiming the deduction, please\advice me

whether tatkal train charges is eligible in ltc?

Whether LTA exemption can be claimed where journeys performed by members of family in different months and also where employee has not accompanied with the family?

Govt. is giving the LTC facility to his employees once in 4 year's block in all india tour. Curbing the entitlement, Economy class Normal fare in air, govt. is not making justice. the recent LTC clarification dated 10th Nov, 2008 is ambiguous and need clear cut instruction. I have the following doubts, which may be replied.

Sub: Clarification in respect of OM 7(1)/E.Coord/2008 dated 14 th November, 2008
 
            I have applied for LTC advance to visit NE in lieu of Home Town for the block year 2006-07 within the grace period ending 31-12-2008. The sixth pay commission vides OM No. 31011/4/2008-Estt. (A) dated 23 rd September, 2008 has allowed air travel for officers having grade pay 5400 and above on tour/transfer or LTC. The finance ministry vide OM 7(1)/E.Coord/2008 dated 14 th November, 2008 has directed that the LTC travel by air on Cheapest Economy Fare will be allowed. In this regards clarifications on the following points are requested.
 
  1. Whether the cheapest fare means the lowest fare of Economy Class among the airlines or it is the Flexi fare type air ticket.
  2. How to book the tickets if the flight timing of cheapest fare does not suit to the individual.
  3. For LTC travel to North East vide O.M. No. 31011/4/2007-Estt.(A) dated 2nd May, 2008 and subsequent clarifications dated 14 th May, 2008 in which Full fare will be admissible to the categories of employees indicated therein. In this connection whether the cheapest economy fare is also applicable for LTC to NE.

Reply: The cheapest fare is NACIL LTC-80 fare applicable for booking of LTC tickets w.e.f. 01-12-2008. Pl check on https://www.indianairlines.in/scriptts/leavetravelconcession.aspx .  I think, condition of cheapest fare is not applicable to NER LTC in lieu of Home Town LTC as both the Min. of Fin. circulars dated 10/11/2008 and 04/12/2008 do not refer the DOPT Circulars dated 02/5/2008 and 14/05/2008.  LTC to NER was allowed by govt. by relaxing the LTC rules on temporary basis for a period of two years to promote the tourism activities in NER and full fare is admissible as per clarification dated 14/5/08.  If condition, of cheapest fare is applied to NER LTC also, then only a few  officials not entitled for travel by air will prefer to avail the facility.  The officers drawing grade pay of Rs.5400 (entitled to travel by air) and availing All India LTC will prefer to visit other places rather than visiting NER which is partially considered as backward and terrorism affected region and the purpose of the Govt. to promote tourisom activities will defeat.  However, this is a personal opinion and clarification by Govt. of India, Min. of Fin./DoPT shall be final.

DOP&T O.M.No.31011/4/2008-Estt.(A) dated 23 September 2008 Kindly clarify the following points on the Rule 8-Types of LTC mentioned in the above letter reference No 3 dated 23 September 2008. 1. Who is referred as fresh recruits or new recruits in that O.M. Please give the relevant date and Central Government order reference for our office purpose. 2.Whether a Government officer (Group-A, Gazetted under DRDS) joined in Central Government service for the first time by direct recruitment on November 2004 and got regularized, can travel to NER on LTC by converting one block (2008-2009 ) of home town LTC. I have already availed the all India LTC (any where in India) in March 2007 for the block year 2006-2009. 3. LTC80 scheme is eligible in future example: 2009 or 2010 e.t.c and give detail for LTC and list of destination

URGENTLY NEED SOME INFORMATION.

SIMILAR TO THE IN LIEU OF HOMETOWN LTC TRAVEL TO NORTH EAST, THE GOVT HAD COME UP WITH A PLAN FOR ANDAMAN ISLANDS IN 2005-2006 FOR A PERIOD OF 6 MONTHS. IT IS HOWEVER RUMOURED THAT THE TRAVEL TO ANDAMAN IN LIEU OF HOMETOWN LTC HAS BEEN FURTHER EXTENDED.

ANYONE HAVING ANY INFORMATION ON THE SUBJECT KINDLY INFORM ME ABOUT THIS ALONG WITH THE GOVT OF INDIA LETTER REFERENCE PLEASE.

My employer has rejected my LTA claim for the FY 2009-10. Can I claim LTA exemption while filing my ITR? If yes, should I inform my employer of the same?

Also, is it correct on the part of employer to reject LTA claim by employee?
