Claiming of Expenses?

Sim Card (post paid) purchased in name of husband (as scheme for existing user was attractive), but the said sim card is being used by Wife for her Profession since inception. Wife making all the payments of Bills by crossed cheque from her account since last 4 years & showing as her expenses in regular ITR’s. The Bill comes in name of Husband. Can she face any problems?

As per law you can claim expense in the name of wife when the bill is in name of wife.... Though the payments are made by wife it is not clear whether she is using or not for her profession. so its not possible to claim expenses.

Better from the next year ask not to claim or transfer the name.

As we all know that department always ask for supporting papers for all the expenses claimed in the books of accounts. As the bill is in the name of Husband it wlll be difficult and also time consuming task to prove that the mobile expenses are of the assessee, so i think that the chances of disallowance are more.

Better to Transfer The name .Its Hardly Take 3 Working Days.As Recently I Have Done Same.........

But You Can Take a Approval Letter From Husband That This SIM Used by Wife..& Hence There Fore All Expenses Will Be Beared By Wife Only.........

 

No ,there can be no problem as it is paid by crossed cheque from her account . But for the sake of conveience get the name changed on mobile bills

No not a problem, she can very well keep claiming... There is no restriction in law saying that the telephone connection the assessee uses should be in the name of the assessee

Well,

My friend you can claim expense only if the bill is in your name. Its the  general rule to claim deduction....

No law is required for the allowing in the name of other or in the same name....
