Change in pan status and defective return u/s139(9)

A co-operative housing society  with a PAN registered as Artificial Judicial person has filled a defective return (they did not receive deduction under 80P due to their AJP status even though they are eligible for it) , now they have received a notice u/s139(9).

     They have come to me for advice,

1) I cannot file a revised return in reply to 139(9) as they still cannot claim their 80P deduction due to their AJP status .

2)  Change in status from AJP to Co-operative society it is a compulsion to surrender the AJP Pan to AO and obtain a co-operative society PAN

What is the best course of action  Should i seek an extension to 139 (9) from AO ,and state that the extension be granted till there is change in status or is their any other way?

The PAN registration itself is wrong. Registeration is PAN wise, I don't think that there's any other way ,other than applying for new PAN and file a new return. The old return will have to be treated defective and new return will have to be filed.

 

Please do consider other views also.
