Cenvat - reverse charge

Queries 477 views 3 replies

A Service Receiver paid Service Tax on Works Contract on partial reverse charge basis for FY 2012-13 and FY 2013-14 togther with Interest on 31/3/14. The amount comes to around 2 lacs.

From April 2014, he claims the above amount paid against his ST liability as a service receiver.

Still there are amounts unexhausted from the Input credit available of Rs.2 lacs. Is there any time limit before which it has to be claimed or no limit as in case of normal cenvat ?

CENVAT credit shall be availed in the current return, it can be carried forward utilised for future periods. In my opinion there is no time limit specified for utilisation of available credit.

From September onwords input credit must be availed with in 6 months from the date of invoice.

Condition is : 6 Months
